The PNK Stuff warranty obligations for the product you have just purchased (the “Product”) are limited to the terms set forth in this document. The PNK Stuff warrants the Product against defects in materials and workmanship for a period of one (1) years from the date of original purchase (“Warranty Period”). Except where prohibited by applicable law, this warranty is nontransferable and is limited to the original purchaser and the country in which the product was purchased. If a defect arises and a valid claim is received by The PNK Stuff within the Warranty Period, at its option, The PNK Stuff will repair the Product or exchange the Product with a functionally equivalent new product. The PNK Stuff warrants repaired Products and replacement products provided hereunder against defects in materials and workmanship from the date of the repair or replacement for thirty (30) days or, if longer, for the remainder of the Warranty Period. If the Product is exchanged, the replacement product becomes your property and the Product becomes The PNK Stuff property. When a refund is given, the Product becomes The PNK Stuff property.
CONSUMER PROTECTION
For consumers who have the benefit of consumer protection laws or regulations in their country of purchase or, if different, their country of residence, that cannot be disclaimed as set forth above (“consumer laws”), the benefits conferred by this warranty are in addition to all rights and remedies conveyed by such consumer laws. To the extent that liability under such consumer laws may be limited, The PNK Stuff liability is limited, at its sole option, to replacement or repair of the product.
REMEDIES
The PNK Stuff’s entire liability and your exclusive remedy for any breach of warranty shall be, at The PNK Stuff’s option, (1) to repair or replace the hardware, or (2) to refund the price paid, provided that the hardware is returned to the point of purchase or such other place as The PNK Stuff may direct with a copy of the sales receipt or dated itemized receipt. Shipping and handling charges may apply except where prohibited by applicable law. The PNK Stuff may, at its option, replace your product, offer to provide a functionally equivalent product, or repair any product with new, refurbished or used parts as long as such parts are in compliance with the product’s technical specifications. Any replacement hardware product will be warranted for the remainder of the original warranty period or thirty (30) days, whichever is longer, or for any additional period of time that may be applicable in your jurisdiction. This warranty does not cover problems or damage resulting from (1) accident, abuse, misapplication, or any unauthorized repair, modification or disassembly; (2) improper operation or maintenance, usage not in accordance with product instructions or connection to improper voltage supply; (3) use of consumables, such as replacement batteries, not supplied by The PNK Stuff except where such restriction is prohibited by applicable law; (4) lost parts that were originally supplied with The PNK Stuff hardware product; (5) 3rd-party parts and accessories not purchase from The PNK Stuff; or (6) normal wear and tear. This limited warranty does not, under any circumstances, cover the replacement of or reimbursement for any electronic device or personal property that is not a The PNK Stuff product. This warranty also does not cover The PNK Stuff products used by businesses for the purpose of providing end users with Internet access for a fee.
